We are setting up our WFOE in China and the first thing is to rent an office. I am confused how can you get a business license to sign the leasing contract which is required by the government to issue that business license?

To set up a WOFE in China, you must rent an office as the registered address of the WOFE, and the leasing contract is required during the registration process. It is true that the name of the leasee on the contract shal be the company name to be established in China, but business license of the new company is not required to sign the leasing contract. To save time, usually we advise the investor to sign the leasing contract under his/her individual name, and change it into the company name after pre-name check with Administration of Industry and Commerce which guarantees the name can be used for registration.
